Terms of Use
These Terms of Use (the “Terms”) govern your use of the Calendar Lab app (the “App”), published by Ricardo Riet Correia (the “Developer”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
The App is licensed to you under Apple's Standard Licensed Application End User License Agreement (the “Standard EULA”). These Terms supplement the Standard EULA. If there is a conflict about the license to use the App, the Standard EULA prevails.
2. Purpose and limits of the App
- The App is a support tool for personal roster organization. Duty limits, rest, fatigue, home and airport standby, estimated pay and all other calculations are for information only and may contain errors or become outdated.
- The official roster, company rules, RBAC 117, ANAC regulations and applicable law always prevail. Operational, rest and fitness-for-duty decisions remain the responsibility of the crew member and the company.
- The App does not provide medical advice. Sleep and fatigue information does not replace medical evaluation or the company's fatigue risk management programs.
- The App reads the source calendar without changing it and writes only to the destination calendar (Calendar-Lab).
3. Independence and third-party trademarks
The App is independent and is not affiliated with, sponsored by or endorsed by LATAM Airlines, IBS Software (iFlightNeo), ANAC, API Crew Care, Jeppesen or any other company, authority or portal mentioned. Third-party names and trademarks belong to their owners and are used only to identify compatible services.
4. Third-party services and terms
When using the App, you must comply with the terms of the third-party services involved, such as your company's systems and portal usage policies and Apple's terms. Access to third-party portals inside the App depends on your own credentials and authorization, and the Developer does not control those portals' availability or content.
5. Privacy
The processing of personal data is described in the Privacy Policy, which forms part of these Terms.
6. Support
Support for the App is provided by the Developer, as described on the Support page. Apple has no obligation to provide maintenance or support for the App.
7. Limitation of liability
Subject to consumer rights that cannot be waived, the App is provided “as is”, with no guarantee that it will run without interruption or error, or that its calculations will always be correct. To the maximum extent permitted by law, and without prejudice to the rights granted by Brazil's Consumer Protection Code, the Developer is not liable for indirect damages, or for damages arising from decisions made solely on the basis of the App's information, from incorrect data supplied by the roster or third-party portals, or from those services being unavailable.
8. Changes
The Developer may update these Terms. The date at the top shows the current version. Continuing to use the App after an update means you accept the new version.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the consumer user's place of residence have jurisdiction, as provided by Brazil's Consumer Protection Code.
